Terms of Service Welcome to the eCWusers online users group. To participate, you must register as a member. To register, please review the following Terms of Membership ("Terms") carefully. By registering, you agree to abide by these Terms. Registration Although we intend to be as inclusive as possible, registration is limited to physician offices and users of eClinicalWorks software ("eCW"), as well as physicians evaluating the eCW software. We welcome individual IT support persons, supporting eCW practices, and representatives of eClinicalWorks, LLC ("eCW") as well. In certain cases we may not permit users to register for these Forums, at our own discretion and for any reason. For example, if eCW has no record of registrant as having demo'ed their software. License to Use Posted Materials; Monitoring Subject to the Posting Rules set forth below, by submitting messages, information, data, text, files, links, artwork, photographs, software, or other materials ("Materials") to any of these Forums, you automatically grant (or warrant that the owner of such Materials has expressly granted) us the royalty-free, perpetual, irrevocable, non-exclusive, worldwide right and license to use, reproduce, modify, adapt, publish, translate, take excerpts from, incorporate into other works, create derivative works from, distribute, perform and display such Materials (in whole or part), in any form, media, or technology now known or later developed. Any message posted on our Forums expresses only the views of the author of the message and does not necessarily reflect the views of these Forums or any person or entity associated with them or of eCW. Although these Forums use moderators and administrators from time to time to monitor the Materials posted in our Forums for compliance with these Terms, we cannot and do not pre-screen or monitor all such Materials. Posting Rules and General Rules of Conduct You agree that you will not use or allow others to use your membership in these Forums to: 1. Post or transmit any Materials, or links to any Materials, which are knowingly false and/or defamatory, libelous, inaccurate, abusive, vulgar, hateful, harassing, obscene, profane, sexually oriented or threatening, which violate the right of privacy or any other right of any person or entity, or which intentionally or unintentionally violate any local, state, federal or international law or regulation. 2. Post or transmit any Materials, or links to any Materials, that infringe any patent, trademark, trade secret, copyright, right of publicity or other proprietary rights of any party. Impersonate any person, or falsely state or otherwise misrepresent your affiliation with a person or entity. 5. Post or transmit any file that contains viruses, corrupted files, "Trojan Horses", or any other contaminating or destructive features that may damage someone else's computer. 6. Post or transmit any Materials elsewhere, or link to any Materials, contained in this forum without the permission of both the original author (poster) of said Material and of the site's administrator. We reserve the right to edit or delete any message for any reason whatsoever, at any time and at our sole discretion. Privacy We reserve the right to disclose your identity, your postings and any other information we may know about you in the event of any complaint or legal action arising from any Materials posted by you, or in the event we believe such disclosure is necessary to comply with any law, legal process or government order, to protect and defend our rights or property or enforce these Terms, or to protect the personal safety of other members of these Forums or the public. Your contact information will otherwise never be sold or given away for commercial purposes. The information and other Materials you post or transmit on the Forums may be viewed by any Forum visitors. Please do not post any private information unless you want it to be available publicly.
